These Terms of Service ("Terms") govern your access to and use of the NammaPetti application and website (the "Service"), operated by NammaPetti ("we", "our", or "us"). Please read these Terms carefully before using the Service. By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age and a resident of India to use the Service. By using NammaPetti, you represent and warrant that you meet these requirements and have the legal capacity to enter into a binding agreement.

2. Description of Service

NammaPetti is a digital emergency binder that helps Indian families:

Securely store and organize important documents (Aadhaar, PAN, insurance policies, property papers, etc.)
Track and manage nominee details across financial accounts
Monitor net worth with a unified dashboard
Set up legacy access protocols for trusted family members
Receive expiry and renewal alerts for time-sensitive documents

The Service is provided for personal, non-commercial use by individuals and families.

3. Account Registration & Security

You must provide accurate, current, and complete information during registration.
You are solely responsible for maintaining the confidentiality of your account credentials, encryption keys, and recovery phrases.
You must immediately notify us of any unauthorized use of your account.
Due to our zero-knowledge encryption, if you lose your encryption keys or recovery phrase, we cannot recover your vault content. You acknowledge and accept this risk.

4. Your Content & Data Ownership

You own your data. All documents, information, and content you upload to NammaPetti ("Your Content") remain your property. We do not claim any ownership, license, or intellectual property rights over Your Content.
You grant us a limited, encrypted-only license to store and transmit Your Content solely to provide the Service to you.
You are responsible for ensuring you have the legal right to store any documents you upload and that Your Content does not violate any applicable law.
You can export or delete Your Content at any time through the app.

5. Legacy Access & Family Sharing

You may designate trusted family members ("Legacy Contacts") to receive access to your vault under conditions you specify.
You are responsible for keeping your Legacy Contact designations current and accurate.
NammaPetti facilitates the access transfer process based on your configured protocols but does not verify the identity of Legacy Contacts beyond the authentication methods you set up.
We are not liable for any disputes between you and your Legacy Contacts regarding access to Your Content.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or to store content that violates Indian law
Store forged, fraudulent, or illegally obtained documents
Attempt to circumvent, disable, or interfere with any security features of the Service
Use the Service to facilitate money laundering, tax evasion, or any financial crime
Reverse engineer, decompile, or disassemble any part of the Service
Use automated systems (bots, scrapers) to access the Service
Share your account credentials with third parties or allow others to use your account (use the Legacy Access and Family Sharing features instead)

We reserve the right to suspend or terminate accounts that violate these terms, with notice where practicable.

7. Service Availability & Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.
We may modify, update, or discontinue features of the Service. For material changes that affect your stored data, we will provide at least 30 days' notice and ensure you can export Your Content.
If we discontinue the Service entirely, we will provide at least 90 days' notice and assist you in exporting Your Content.

8. Fees & Payment

NammaPetti currently offers a free tier. If we introduce paid plans in the future:

We will clearly communicate pricing before any charges apply.
Your existing free-tier features and data will not be restricted retroactively.
All prices will be listed in Indian Rupees (INR).
Applicable GST will be charged as required by law.

9. Privacy

Your use of NammaPetti is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

10. Intellectual Property

The NammaPetti name, logo, design, codebase, and all associated intellectual property are owned by NammaPetti. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that:

The Service will be error-free or uninterrupted
The Service will meet your specific requirements beyond its described functionality
Any information stored in the Service constitutes legal, financial, or tax advice

NammaPetti is a document organization tool, not a legal or financial advisory service. Always consult qualified professionals for legal, financial, or tax matters.

12. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

NammaPetti shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Our total aggregate liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or INR 5,000, whichever is greater.
We are not liable for any loss arising from your failure to maintain the security of your account credentials or encryption keys.

13. Indemnification

You agree to indemnify and hold harmless NammaPetti from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your use of the Service, or your violation of any law or rights of a third party.

14. Termination

By you: You may delete your account at any time through the app. Upon deletion, Your Content will be permanently erased within 30 days.
By us: We may suspend or terminate your account for violation of these Terms, with notice where practicable. In case of termination, we will provide a reasonable period for you to export Your Content, unless the termination is due to illegal activity.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails, disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bengaluru, Karnataka.
The courts of Bengaluru, Karnataka shall have exclusive jurisdiction for any matters not subject to arbitration.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice within the app at least 15 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may delete your account before the effective date.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
